Supreme Court allows Morbi bridge collapse victims to file fresh petition
The Supreme Court has allowed 112 victims of the Morbi bridge collapse to file a new petition under Article 32 of the Constitution. The decision comes after Gujarat High Court had rejected their earlier petition seeking a CBI investigation and the application of Section 302 against the accused.
The Supreme Court, in its order, stated that the high court’s decision was incorrect and that the petitioners have the right to file a fresh petition under Article 32. The court will now independently assess the merits of the petition and deliver a judgment.
The victims’ petition argued that the high court had erred in its judgment by not considering the gravity of the situation. They pointed out that the Morbi bridge collapse was not an accident, but a criminal act of negligence.
The petition highlighted several crucial points
The Morbi Collector, who is responsible for the maintenance and safety of public infrastructure, was not questioned during the investigation despite his clear responsibility in the matter.
The investigating agency deliberately delayed the investigation, ignored crucial evidence, and even manipulated witness testimonies to benefit the accused.
