Family law: Pre-litigation Lok Adalats to ease burden on Guj courts

Family disputes, especially legal ones, can be very messy, and go on for years, causing long-lasting mental, physical, and financial hardships. To combat this, the High Court of Gujarat and the Gujarat State Legal Services Authority (GSLSA) will establish a permanent pre-litigation Lok Adalat in the state.
In Gujarat, matrimonial disputes account for a significant portion of cases filed in court.
Such matrimonial conflicts often lead to multiple applications and litigations, starting from the magistrate’s court to the sessions court, high court, and even the Supreme Court.
The new judiciary bodies will focus on resolving family disputes, especially matrimonial conflicts, through mediation and mutual dialogue in a timely manner.
Administerial push for the provision
Currently in the final stages of implementation under the guidance of Chief Justice and Patron-in-Chief of the state’s Legal Services Committee Sunita Agarwal, and GSLSA executive chairman Biren Vaishnav, the initiative is expected to be implemented within a matter of days, once the formalities are completed.
GSLSA member secretary Rahul Trivedi has directed all the district-level legal services authorities in Gujarat to establish such permanent pre-litigation Lok Adalats, for which preparations are underway.
Legality behind Lok Adalats
Any agreement or settlement reached in this pre-litigation Lok Adalat will have the same weight and authority as a civil court decree, allowing for the resolution of disputes between a couple or family members.
Initially, these permanent pre-litigation Lok Adalats will be established in the City Civil and Sessions Court complex at Bhadra in Ahmedabad and the District Court complex located in the Navrangpura area for rural cases.
Permanent pre-litigation Lok Adalats will also be set up in various districts across the state, officials said.
