Citizen to be paid ₹10k by Indian Railways for 5-hour delay

Have you ever received a refund for the late arrival of your train or even flight? In a significant judgment, the Consumer Disputes Redressal Commission Ahmedabad (Rural) directed Indian Railways (IR) to pay a refund with interest, and ₹7,000 more to the customer who bore late arrival of the train.

The complainant was about to travel in the Kolkata-Ahmedabad Express train which turned out to be five hours late, prompting him to reach Ahmedabad on a general ticket.

Commission stated, “The Kolkata- Ahmedabad Express train was five hours late, due to which the complainant had to reach Ahmedabad on a general ticket. It is clear that the railway authorities failed to provide service and the complainant was successful in proving the deficiency in the railway administration’s service. The Commission did not accept the defence made by the railway authorities.”

“Evidence including tickets, a photo of the station’s display board showing the train’s status, a screenshot of the train’s live status, a copy of the general ticket, legal notice, email, and letter were submitted by the complainant party. Based on this the entire case inclined on his side,” they added.

Commission’s President KM Dave and member BJ Acharya directed IR to pay ₹3,300 refund amount with 9% interest from the application date Aug 8, 2021, to the complainant who bore a five-hour delay of the train.

The railway authority was directed to pay a total of ₹7,000 to the passenger which included ₹5,000 for mental harassment and ₹2,000 towards complaint costs.
