Nasir Nagar Demolition Case: Those Responsible For Irregularities Will Face Action, says Gujarat HC

The Gujarat High Court questioned the police and Surat Municipal Corporation (SMC) over the action taken following the Nasir Nagar mega-demolition case, while the Advocate General, who had earlier appeared for the corporation, remained absent during the latest hearing.

The petitioners told the court that the alternative accommodation provided to them was in a dilapidated condition and was not suitable for habitation.

HC Questions Police, Corporation Over Action Taken

During the hearing, Justice Nikhil Kariel questioned the police department about the action taken in the matter. The court also sought details from the corporation regarding the steps taken for the affected residents.

After examining the corporation's response, the court observed that it was not satisfied with the reply submitted by the civic body.

The court also directed the responsible SMC officials to take appropriate action and cautioned that accountability would be fixed if any irregularities were established.

'Those Responsible Will Have to Face Action'

The court reportedly cautioned officials involved in planning and executing the demolition to remain prepared if wrongdoing is established.

Officials who prepared the design for removing the alleged encroachments, as well as those who acted with excessive zeal, would be held accountable if found responsible, the court observed.

The court further made it clear that the matter would not be limited to the investigation being conducted by the government-appointed committee and that the civic body would also be required to provide accurate information to the court.

Court Says Advocate General Should Remain Present

The court also commented on the absence of the Advocate General, observing that even if the Advocate General did not make submissions before the court, he should remain present as the senior representative of the government.

During the hearing, Advocate Anuj Trivedi appeared on behalf of the government/corporation in place of the Advocate General.

State Monitoring Team Report Awaited

The High Court directed the SMC and police department to ensure that further action is taken in the appropriate direction.

As the report of the State Monitoring Team is still awaited, the court has scheduled the next hearing for September 29.
