Overseas accused unreachable, bail guarantor served recovery warrant

After the main accused, residing in Australia, failed to appear before the court despite multiple summons through email, a court in Ahmedabad issued a recovery summons of ₹10 lakh against the bail guarantor of the accused.

According to the details of the case, the accused, named Hardik Pathak, had borrowed ₹30 lakh from Rahul, who went to Sydney for his education in 2010.

Rahul joined Hardik’s Indian Dosa Plaza as an employee. In 2016, Hardik asked Rahul for financial help, as his business partner had bailed out.

Rahul arranged the amount for Hardik from the former’s father, who had recently retired from the Railways at that time.

When Rahul’s father, the complainant, asked for a guarantee, Hardik’s father Harnish Dave had assured him of repayment.

However, since the money was not returned, a case was filed against Hardik by Rahul’s father.

As a bail guarantor, Hemal Dave had filed for anticipatory bail of ₹10 lakh for Hardik since he was in Australia.

Now that Hardik is unreachable and is not responding to the court summons, the court has sent a recovery warrant of ₹10 lakh to Hemal Dave.
