RaGa challenges sessions court re-hearing of remarks on Sikhs in Allahabad HC

A revision plea has been filed seeking a re-hearing of the case in which Rahul Gandhi was accused of making remarks about Sikhs during his visit to US, as per reports. The case had earlier been reportedly dismissed by a Varanasi court.
After a session court permitted the matter to be reheard, Rahul Gandhi challenged the plea in Allahabad HC.
What was the remark?
Rahul Gandhi, the Leader of Opposition, allegedly made an objectionable statement during his US visit, saying that there was “an atmosphere of insecurity among Sikhs in India”.
According to complainant Nageshwar Mishra, the remark was provocative and allegedly inciteful, which led him to file a plea in the magistrate court in Varanasi.
The magistrate court, however, rejected the plea on the grounds that matters outside India cannot be heard in Indian courts under Section 208 of BNS (Bharitya Nyay Sahita), according to reports.
After this judgment, a revision plea was filed in the sessions court, which permitted the matter to be re-heard.
In response, Rahul Gandhi has now filed a plea in the Allahabad High Court challenging the sessions court’s order for a re-hearing.
The matter is reportedly listed before a single bench of justice Sameer Jain, who will hear his criminal revision petition on Monday.
