Kerala’s Hindu organisation moves SC against Waqf Amendment Act; says it ‘threatens Muslims’

A Kerala-based Hindu organisation, Sree Narayana Manava Dharmam Trust, has filed a plea in the Supreme Court challenging the Waqf (Amendment) Act, 2025, arguing that the law threatens the very existence of the Muslim community in India, as per reports.
The Trust was founded in 2023, to promote the ideals of Sree Narayana Guru, a philosopher, spiritual leader and social reformer known for championing social equality and opposing caste discrimination.
As per reports, the plea argues that the 2025 amendment includes a ‘fraud on the Constitution’ and effectively abolishes the traditional Islamic practice of Waqf.
According to the Trust, the amended law allegedly replaces the religious institution of Waqf with a ‘state-designed mechanism’ that undermines its theological and legal foundations.
‘Parliament has no authority to abolish an ancient religious practice such as Waqt,’ the Trust reportedly argued.
According to the plea, they further argued that the amended law imposes ‘an unconstitutional sui generis and state-designed scheme’ that is against the constitutional rights of the Muslim community under Articles 21, 25, 26, and 29 (1).
According to reports, the Waqf matter will be heard on Monday by a bench comprising Chief Justice of India (CJI) Sanjiv Khanna, Justice PV Sanjay Kumar, and Justice KV Viswanathan.
