Allahabad HC raises concerns over UP Police functioning

The Allahabad High Court has made strong observations about the functioning of the Uttar Pradesh Police, saying that many officers appear to be more loyal to the government in power than to the Constitution, as per reports.

The court reportedly made the remarks while hearing a case related to the Uttar Pradesh Gangsters and Anti-Social Activities (Prevention) Act, 1986. The court said political influence has affected the state’s administrative system for years, especially in police transfers, postings and promotions, as per reports.

According to the court, officers considered close to the ruling establishment often receive important postings, while those who act independently may be transferred to less significant positions. The judge reportedly observed that some officers shape their actions to please political leaders rather than follow constitutional principles.

The court also expressed concern over the misuse of police powers. It noted that arrests are sometimes made without proper legal procedure, FIRs may be registered or ignored for ulterior motives, and preventive detention laws are occasionally used in an arbitrary manner, as per reports.

It further stated that some police officers treat the rule of law as an inconvenience rather than a constitutional duty. The court reportedly said that legal safeguards and judicial orders are often followed only on paper and not in spirit.

The High Court also reportedly criticised the functioning of some senior officials and said government officers must remain accountable to the law and the Constitution, not to any political establishment. However, since related issues are currently being considered by the Supreme Court, the court did not give a final ruling on the matter, noted the reports.
