Trans Americans to lose passport choice as Supreme Court allows Trump policy

The US Supreme Court has reportedly cleared the way for the Trump administration to enforce a rule that prevents transgender and nonbinary Americans from choosing passport gender markers that reflect their gender identity.

According to reports, in a 6–3 ruling, the Court has allowed the government to proceed with the restriction while the legal challenge against it continues in a lower court.

This decision effectively pauses a previous lower-court order which had directed the government to keep offering the ‘male’, ‘female’ and ‘X’ options to applicants based on their self-identified gender.

The move follows a request from the US State Department to lift the judge’s injunction that had temporarily blocked the policy. 

The administration’s stance comes from an executive order issued earlier in the year by President Donald Trump, which stated that the US would recognise only two sexes male and female determined solely through birth documentation and biological classification.
