Wife files petition over husband’s custodial death in Guj High Court

A wife has filed a writ petition in the Gujarat High Court, alleging that her husband, detained by the Navrangpura police in a cheating case, died in custody due to police brutality.
During the hearing, Justice Hasmukh Suthar issued a notice to the state government and the police. Further, the High Court called for the investigation papers of the case and the report on what investigations have been conducted so far.
In the writ application filed by the wife in the High Court, an allegation was made that Dipak Panchal, her husband, was detained by Ahmedabad’s Navrangpura Police on Jan 1.
While in police custody, her husband’s health suddenly deteriorated, following which he was admitted to the hospital for treatment, where he tragically died on Jan 4.
It was alleged by the petitioner that her husband was subjected to custodial torture and ill-treatment by the police in the custody of Navrangpura Police, leading to his death.
The petitioner had requested the concerned authorities including Navrangpura Police and the commissioner of police, to file an immediate FIR of custodial torture, conduct a proper investigation, and take action against any guilty police officers and employees responsible.
However, since no action was taken, she had to file a writ petition in the High Court.
The petitioner’s side argued that since the officers of Navrangpura police are involved in this case, the formation of a SIT (special investigation team) was a viable option for a fair investigation.
After considering the petitioner’s submission, the High Court issued the said notices and summoned the investigation papers of the case from the police for the next hearing.
