Gujarat HC ‘not inclined’ to quash 2006 FIR against Teesta Setalvad

Earlier SC had stayed the Gujarat HC order for a week and granted interim bail to Teesta.

Gujarat High Court has conveyed a preliminary disinclination to quash the FIR filed against prominent activist Teesta Setalvad.

This FIR, originating from the Mahisagar district in 2006, pertains to the controversial Pandarwada mass grave digging incident. Setalvad is accused of exhuming bodies of 2002 Gujarat riot victims, allegedly to create a media sensation.

During the proceedings on Jan 1, justice Sandeep Bhatt while addressing Setalvad’s counsel questioned the need to revisit cases which he metaphorically referred to as “dead horses”.

The court has scheduled the next hearing for Jan 9, where further deliberations are expected.

Supreme Court in its order today extended the interim bail of social activist, Teesta Setalvad, till July 19, and issued notice to the Gujarat government seeking its reply on the plea filed by her, after the Gujarat high court rejected her regular bail in a case of the alleged fabrication of evidence in relation to the 2002 Gujarat riots. 

A two-judge bench of the Apex Court, headed by Justices B R Gavai and J B Pardiwala, passed the order and extended the interim bail of Setalvad till July 19, and issued notice to the Gujarat government for its reply. 

Teesta had to move to the Supreme Court after the Gujarat high court rejected her bail and directed her to surrender immediately in the case. 

Earlier the Supreme Court had stayed the Gujarat high court order for a week and granted interim bail to Teesta. 

The Supreme Court extended the interim bail of Teesta, after hearing her plea in which she sought regular bail in the case of alleged fabrication of evidence in relation to the 2002 Gujarat riots. 

"We will list the case after two weeks. List the case on July 19, 2 p.m. for the hearing. One hour for this side and one hour for the respondent. Issue notice (Gujarat government), returnable on July 19. All the documents are to be filed before July 15 after giving each other," Justice Gavai said and made it clear that the court wants to decide it that day (July 19) only.
