SC clears path for Chharanagar slum redevelopment rejects plea challenging demolition

The Supreme Court on Monday dismissed a petition challenging the demolition of a slum area in Ahmedabad’s Chharanagar.

During the hearing, a bench comprising Justices Surya Kant and N Kotiswar Singh rejected the petition and cleared the way for the Amdavad Municipal Corporation (AMC) to continue the redevelopment.

Petitioner’s side argued that the petitioner had not been informed why their objections to a public notice were rejected. 

AMC claimed that the redevelopment procedure is in compliance of all the rules.

The residents filed a plea seeking more than one house as there were more than one member in their family. Secondly, the additional space where they worked should also be taken into account during house allocation. The AMC has carried out the work without following due procedure.

To this, Public Prosecutor Gursharan H Virk, appearing for the respondents, told the court that the petitioner’s requests were ‘unreasonable’.

He said that no one can be allotted more than one house, as there are no such provisions in the Slum Rehabilitation Scheme.

The redevelopment will benefit the slum dwellers as they will have proper facilities in the new scheme.

Virk informed the Court that 740 out of 741 occupants had accepted the rehabilitation scheme, with only the petitioner’s family objecting.

He brought to the SC’s attention that a total of 38 modern high-rise towers will be constructed as part of this project in the Chharanagar area. Out of these, the process for 17 high-rise towers has already been completed, and the work on constructing the remaining high-rise towers is in full swing. 

After listening to both sides, SC dismissed the petitioner’s plea, paving the way for AMC to go all out for the Chharanagar project.

In 2022, AMC planned to make the city slum-free with a view to increasing the living standard and environment of slum dwellers or urban poor by providing them with dwelling units and affordable houses with all basic facilities and amenities.

According to the archives of AMC, under the Gujarat Slum Rehabilitation Policy –PPP-2013, the corporation constructed a total of 5,462 houses in 14 different slums and allotted to slum dwellers in various slum locations including Chhanaji na chhpra, Fakira tank na chhapra, Ektanagar Chunara Vas-Ramgali, and more across seven zones.
