In a recent hearing, Gujarat High Court has ruled that if a tenant misuses a rented property in violation of the rental agreement, the owner has the right to evict them. The court emphasised that an owner does not need prior permission to initiate legal proceedings in such cases.

The case in question involved a dispute where a landlord sought to evict a tenant who was allegedly engaging in unauthorised activities on the rented premises. The High Court ruled that if a tenant is found using the property other than intended use or breaching contract terms, the owner has rights to initiate eviction proceedings.

The ruling clarifies that property owners have legal standing to take action against tenants who violate rental terms without requiring the court’s approval beforehand.

The court also noted that such matters should be handled by the trial court in a timely manner.
