Gujarat judge who refused Rahul Gandhi stay in defamation case, on transfer list with 22 others

Four judges of the Punjab and Haryana HC and one judge of the Allahabad HC were also recommended

Gujarat HC’s justice Hemant Prachchhak was recommended as a judge in the Patna HC

The Supreme Court Collegium, headed by chief justice of India (CJI) D Y Chandrachud, has recommended the transfer of nine high court judges.

The collegium, also including justices Sanjay Kaul, Sanjiv Khanna, B R Gavai, and Surya Kant, held its meeting on Aug 3 and recommended transfers of HC judges for better administration of justice.

It has recommended the transfer of four judges from Gujarat HC, including justices Alpesh Y Kogje, Kumari Gita Gopi, Hemant M Prachchhak, and Samir J Dave.

Justice Hemant Prachchhak and Modi surname defamation case

The Gujarat HC bench of justice Hemant Prachchhak had dismissed the Congress leader Rahul Gandhi’s stay on his conviction in the ‘Modi surname’ defamation case.

Later, a three-judge bench of Justices B R Gavai, P S Narasimha, and Sanjay Kumar was hearing Gandhi’s plea challenging the Gujarat HC’s refusal to stay his conviction, which led to his disqualification from the Lok Sabha.

It is to be noted that the SC on Aug 4 stayed Rahul Gandhi's conviction, and his membership as the MP was reinstated.

Now, Justice Hemant Prachchhak has been recommended for transfer to Patna HC.


Transfer recommendations of other judges

From Gujarat HC, Justices Alpesh Y Kogje, Kumari Gita Gopi, and Samir J Dave were proposed to be transferred to the Allahabad, Madras, and Rajasthan high courts, respectively.

Moreover, four judges of the Punjab and Haryana HC and one judge of the Allahabad HC were included in the list.

Arvind Singh Sangwan, Avneesh Jhingan, Raj Mohan Singh, and Arun Monga of Punjab and Haryana HC were recommended for transfer to Allahabad HC, Gujarat HC, Madhya Pradesh HC, and Rajasthan HC, respectively. 

Vivek Kumar Singh of Allahabad HC was proposed for transfer to Madras HC.
