Singer-performer Kinjal Dave’s controversy over her song ‘Char Char Bangadi Wali Gaadi’ continues as Gujarat High Court today extended the stay on her singing the song till Mar 26.
Previously, the HC had extended this stay till today on Feb 14.
It is noteworthy that Red Ribbon Entertainment Pvt Ltd had approached the HC after their copyright case was dismissed by the Ahmedabad City Civil Court on Jan 30.
The City Civil Court Judge Bhavesh Avashia had held on, “The present suit filed by the plaintiff is hereby rejected/dismissed,” in his order. The court had also directed the plaintiff (Red Ribbon Entertainment) to pay the cost of the suit to defendant No. 1. (Kinjal Dave).
Kinjal Dave’s copyright saga
This legal battle took shape when a local court in Ahmedabad on Jan 17 imposed a fine of ₹1 lakh on the popular Gujarati folk singer.
The penalty was imposed after Dave flouted a previous court directive, which prohibited her from performing the hit song amid an ongoing copyright dispute initiated by a music company.
The legal tussle began in 2019 with Red Ribbon Entertainment Pvt Ltd filing a copyright infringement lawsuit. The dispute hinges on the original creation of the song. Red Ribbon has alleged that Kartik Patel first uploaded the song from Australia on his YouTube channel ‘Kathiyawadi Kings’.
However, Dave had said that the song was written by Manubhai Rabari and composed by Mayur Mehta before RDC Media’s release.
In October 2022, the city civil court had issued an injunction against Dave, restraining her from singing the contentious song. The order also extended to two music companies, RDC Media and Studio Saraswati, restricting them from selling the disputed song in cassettes and CDs.
