Gujarat High Court dismisses PIL against Panjarapol flyover

Gujarat High Court bench of Chief Justice Sunita Agarwal and Justice Pranav Trivedi on Friday dismissed a public interest litigation (PIL) challenging Amdavad Municipal Corporation (AMC)’s controversial project to construct a flyover at Panjarapol junction.

However, the judgement on the objection raised by the petitioner against Ranjit Buildcon Pvt Ltd, which has been awarded the contract by the AMC for the construction of the flyover, was left to the Principal Secretary of the Urban Development Department.

The High Court said that in case of any complaint against Ranjit Construction Company, the Principal Secretary of the Urban Development Department is free to conduct an investigation on his behalf at his level. 

The High Court said that in the petition, the petitioner has made allegations against Ranjit Buildcon regarding the failure of its various projects but there are no solid allegations.

Therefore, the court decided not to challenge the selection of construction company through the tender process, which is not the subject of the challenge.

The High Court also said that we understand that such development projects often require uprooting and replanting of existing trees but this damage can be compensated by replanting of existing trees and growing new trees with the help of technology.
