Gujarat High Court grants no relief to Sheri Affair garba organiser in ‘Safed Parindey’ trademark battle

Gujarat High Court has refused to grant relief to garba organisers Sheri Affair. Sheri Affair had filed a case in the City Civil Commercial Court against Safed Parindey Event Management Company over a commercial trademark issue. After the Commercial Court rejected their plea, Sheri Affair urgently appealed before the high court, seeking a stay against the lower court’s order. However, the high court has turned down their request.

According to Sheri Affair’s claim, they had organised garba at Thakar Farm on SG Highway with the themes ‘Ye Wala Safed’ in 2022, ‘Safed Ishq’ in 2023, and ‘Safed Parindey’ in 2024. This year, they are organising garba with the theme ‘Safed Heroes’. 

They alleged that the opposing Safed Parindey Event Management Company registered their firm under a confusingly similar name and misled people on social media. Sheri Affair had also filed a token compensation claim of ₹1 against the event management company for trademark infringement.

However, a commercial court dismissed Sheri Affair’s injunction plea, stating that the petitioner failed to establish a prima facie case. They were unable to prove their goodwill or provide evidence of sales. They could not produce any supporting documents or records. The word ‘Safed Parindey’ was first applied for trademark registration by the defendants, after which Sheri Affair filed its application. But since the trademark is not yet officially registered, no valid claim can be made.
