Gujarat HC denies anticipatory bail to accused in ₹6 cr cumin scam

In a shocking scam worth crores, Gujarat High Court denied bail to the main accused in a cumin scam whereby another accused took loans on cumin and sold it, then filed a theft complaint to get insurance. 

HC refused anticipatory bail to the cumin scam’s key accused, Anand Chandra of Arya Collateral Warehousing Services.

According to additional public prosecutor (APP) Asmita Patel, Chandra, who is currently absconding and the mastermind of the scam amounting to about ₹6 crores, needs to be interrogated.

Revealing the details of the case, she informed the court that another accused- Chetan Patel had filed a false complaint of stolen cumin after selling it in the open market, having taken bank loans on the commodity.

It is alleged that Chetan was acting on the whims of the key accused Chandra, who is considered the mastermind.

False complaint of stolen cumin

A theft report was filed by Chetanagainst Amit Prajapati, a supervisor of Arya Collateral which is owned by Chandra. According to the complaint, a warehouse in Kadi belonging to Chandra had stored Patel’s 4.54 lakh kg of cumin in 7,406 sacks, amounting to ₹5.62 cr from Mar 16 to Apr 24, 2021.

Chetan had paid a rent of ₹2.5 lakh for the warehouse.

On May 24, 2021, the cluster manager Deepak Vishwakarma, who was in control of the warehouses of Gujarat, called the complainant Chetan and reportedly said that supervisor Amit Prajapati had stolen the cumin, according to the complaint filed.

However, APP Asmita Patel revealed that Chetan had sold the cumin after taking the loans on it. 

The cumin was sold in the open market and crores of rupees were earned from it.

Bank loans and insurance amount

Chetan had taken a loan of ₹2.16 crore from ICICI Bank, ₹93.38 lakh from Axis Bank and ₹94.12 lakh from Aryadhan Financial Solutions on this cumin, out of which ₹90 lakh were transferred to him.

Moreover, an attempt was also made by the accused to get the insurance amount on the basis of the complaint of theft.

Posing these arguments, APP Asmita Patel strongly opposed the anticipatory bail of Anand Chandra, and Justice JC Doshi denied the bail.
