Guj HC to state: Affidavit filed with ‘hota hai, chalta hai’ attitude unacceptable
Expressing dissatisfaction, the Gujarat High Court reprimanded the state government officials for not drafting the affidavit in a particular format, showing a casual attitude towards the documentation.
The bench of Chief Justice Sunita Agrawal and Justice Aniruddha Mayee observed that the state government was filing affidavits without proper drafting and without following the required format.
The court said that the state government’s approach of “hota hai, chalta hai” (it happens, it works) is unacceptable.
The high court also observed that many times officers file weak drafts of affidavits that lack complete information.
In many cases, the identity of the officer who filed the affidavit was not clear, and the affidavit did not mention the specific and relevant information required in the case.
The HC addressed additional advocate general Manisha Shah and said that such weak-drafted affidavits would not be accepted by them.
To this, Shah assured the HC to personally look over the matter and solve the problem.
Notably, the high court had earlier rejected an affidavit filed by the Junagadh collector regarding a PIL over pollution on Girnar. The court had then directed the additional chief secretary of the forest department to file a fresh affidavit.
