Farmer’s land converted to ‘Shri Sarkar’, no action against businessman who had illegally usurped it

A land, usurped illegally by a businessman in Gujarat, is slated to be made ‘Shri Sarkar’ in Gujarat’s Sanand. However, no action has been taken against the businessman.
In the Modasar village of Sanand Taluka, the land owned by a farmer Vasudev Nathalal Shukla, was allegedly taken control of illegally by Janmejay Vyas, the owner of Dishman Pharmaceuticals and Chemicals Ltd.
The authorities, instead of investigating an illegal control of the land, have decided to seize the land from the rightful heirs of the farmer, a complaint suggests.
Timeline
It is worth mentioning that after Shukla died in 1990, his brothers Bhagwat Prasad, Arun Kumar, and Krishnakumar went to inherit his property.
They were told that long before 1990, Vyas had entered his name as a ‘Khatedar’ of the land under Block No 624 in Modasar.
In the application filed in the Revenue Commission, Shukla’s relatives claimed that Vyas allegedly committed this scam in collusion with the then Talati. They claim that no investigation has been conducted against Vyas yet.
Furthermore, in 1996, Vyas had removed his name as a farmer from the land. While removing his name, he had also mistakenly removed the name of Shukla’s sister Kundanbehen.
On February 2, 1995, an inheritance note was issued. But the Talati did not give that inheritance note to the heirs of Shukla.
When Shukla’s relatives had come to know about this, they met the Talati of Modasar village and presented all the documentary evidence they had. The Talati also assured to include their name in the account.
When the note was given to them in 1996, Vyas’ name was still in there, with addition of his daughter – Bhadra’s name this time.
The Shuklas at that time had clarified that they shared no relation with Vyas or his daughter, and the Talati had admitted that the name was included by mistake. The Talati had also asked Shukla’s relatives to not file a complaint with police.
Now, under the Section 63(1) and its sub-clauses of the Gujarat Tenancy and Agricultural Lands Act, mamlatdar has announced the land to be seized by the government, or made ‘Shri Sarkar’.
