74-year-old Vadodara woman loses battle over late husband’s will

A woman in Vadodara lost her appeal in sessions court after challenging her late husband’s will, as the court said she had filed the case too late. 

The court found that she already knew about the will in 2012 but challenged it only after her husband’s death in 2015. As per law, such cases must be filed within three years. 

Her husband had made a will in 2008, giving all property to his children and grandchildren, excluding his second wife.

The legal battle has been going on for 20 years.

• In the year 2008, the old woman’s husband made a registered will.

• The matter reached the High Court in 2012: The old man had presented a copy of the will.

• After her husband died in 2015, the wife filed a lawsuit to revoke the will.

• In April 2024, the Sessions Court rejected the old man’s appeal.

The dispute between the couple had earlier reached the high court over maintenance and domestic violence issues, where the woman had mentioned about the will. The court dismissed her case stating that  legal time limits must be followed.
