Kinjal Dave will not be able to sing her famous ‘Char Char Bangdiwala’ this Navratri, find out why

In the ongoing copyright row over the song ‘Char Char Bangdiwali Gadi’, Gujarat High Court has temporarily suspended the performance of the song until November 4. The court had earlier lifted the stay on performing the song in live shows, public events, or on stage. Red Ribbon Entertainment had sought to challenge this order through an appeal. .
Unless singer Kinjal Dave gets any relief, she will not be allowed to perform the song during the upcoming Navratri festivities. Essentially, although the high court lifted the stay, it put its own order on hold in response to the petitioner’s request.
The case dates back to 2019, when Red Ribbon Entertainment filed a civil suit in Ahmedabad against Kinjal Dave, RDC Media, and Saraswati Studio under Section 55 of the Copyright Act, 1957. Music composer Kartik Patel had claimed that he had originally created the song ‘Char Char Bangdiwala’. Later, Kinjal Dave released the same song on YouTube, allegedly copying his work. Red Ribbon demanded that Kinjal Dave and the media companies stop all activities related to the song.
On January 30, 2024, the civil court dismissed Red Ribbon’s suit and ruled in favour of Kinjal Dave. Dissatisfied with the verdict, Red Ribbon approached the high court, which imposed a stay preventing Kinjal from singing the song at public platforms and extended the restriction in stages.
In the most recent hearing, the high court lifted the stay, thereby granting temporary relief to Kinjal. But following Red Ribbon’s appeal against that order, the court suspended its own relief order until November 4. The case is now expected to come up for further hearing in November.
