A 27-year-old man, Kamlesh Bhuriya, has been sentenced to 20 years of rigorous imprisonment by a Special POCSO Court at the Ahmedabad City Sessions Court for raping a minor girl after allegedly luring her with promises of marriage and taking her to different locations.

The case was registered at Vatva Police Station under provisions of the Bharatiya Nyaya Sanhita (BNS) and the Protection of Children from Sexual Offences (POCSO) Act.

Minor Girl Went Missing In June 2024

According to the case details, the victim’s parents had gone out for labour work on June 2, 2024, when their 17-year-old daughter went missing from the Kadiyanaka area of Vatva village.

After searching for her in Ahmedabad and their native place without success, her father filed a complaint of kidnapping against an unidentified person at Vatva Police Station on June 7, 2024.

The girl and the accused were later traced, following which the investigation revealed that Bhuriya had allegedly lured her with promises of marriage and outings.

Girl Taken To Multiple Locations

According to the prosecution case, the accused took the girl to Bareja and Bavla, and later to his aunt’s house in Dahod, where he allegedly sexually assaulted her repeatedly against her will.

The court noted that the girl was a minor and therefore her consent could not be considered legally valid.

The court also observed that the accused was already married and could not have married the girl, despite allegedly using marriage as a promise to lure her.

Court Relies On Witnesses And Evidence

Special POCSO Court Judge A.B. Bhatt considered the arguments presented by Special Public Prosecutor K.G. Jain.

The court examined the testimonies of 14 witnesses and 21 documentary pieces of evidence before sentencing Bhuriya to 20 years of rigorous imprisonment.

The court found the victim’s testimony, the medical history she provided to the doctor and her statement recorded before a magistrate under Section 164 of the CrPC to be consistent and corroborative.

The court also ordered the accused to pay ₹4 lakh in compensation to the victim.
