Ahmedabad Woman Alleges Husband Hid Existing Marriages, Seeks Domestic Violence Relief

An Ahmedabad woman has approached the Judicial Magistrate Court at Ghikanta, alleging that a man she married after converting from Hinduism to Islam had concealed his existing marriages and later subjected her to physical and mental harassment. The woman has sought protection from domestic violence and monthly compensation of ₹30,000.

Woman Alleges She Was Misled Into Marriage

According to the petition filed through senior advocate Ayaz Sheikh, the woman met Zubair Kucherawala over a mobile phone on December 12, 2012, and the two developed a relationship.

The woman alleged that Zubair, who was already married to Sana Zubair, told her that he did not have a good relationship with his wife and wanted to marry her.

She initially refused, citing her Hindu faith. However, according to her complaint, Zubair allegedly persuaded her to convert to Islam by promising to marry her, provide her with a separate home and take responsibility for her needs.

Alleged Conversion And Marriage

The woman claimed that on December 17, 2016, Zubair took her to a Qazi in the Juhapura area, where she converted to Islam after reciting religious verses.

She alleged that Zubair had assured her that she would be given the status of his wife following the conversion.

According to the petition, the couple subsequently lived together for around 10 years. The woman claimed that Zubair did not provide her with any marriage document or other proof of their marriage.

She further alleged that he took her to different places and had sexual relations with her, following which she suffered a miscarriage.

Woman Alleges Physical And Mental Harassment

The petitioner alleged that the absence of documentary proof of the marriage was later used by Zubair and his family to harass her.

She has named Zubair, his father Abubakar Kucherawala, mother Fatima Abubakar, and his two other wives, Sana Zubair and Jasmine Zubair, in the domestic violence proceedings.

The woman also alleged that Zubair subsequently married for a third time and was now attempting to avoid his responsibilities towards her.

Court Issues Notices

The Judicial Magistrate Court has taken up the domestic violence application and issued notices to the respondents. The next hearing has been scheduled for September 25.

The woman has sought ₹30,000 a month as compensation, along with protection under the domestic violence law.

She has also sought the right to reside in the shared household and protection from being forcibly evicted from the residence.

The allegations are part of the woman's court petition and are yet to be established before the court.
