Two builder brothers have been accused of cheating a Maninagar businessman by selling him a shop for ₹1.10 crore without disclosing an outstanding project loan against the property. The buyer had paid the full amount and obtained a registered sale deed, but later found the shop sealed by Aditya Birla Capital Finance over the unpaid loan.
The Maninagar police have registered a case against the accused, Kamlesh Gondaliya and Rajesh Gondaliya, for alleged cheating and criminal breach of trust and have launched an investigation.
Businessman Pays ₹1.10 Crore for Shop in Maninagar
According to the complaint, Rikesh Giteshbhai Mistry, a resident of Sitabag Society in Maninagar who owns a factory in Vatva, decided to purchase Shop No. 10 on the ground floor of the Takshashila Crest project in 2024.
The shop is located opposite Pushpkunj Society in Maninagar. Mistry finalised the deal for ₹1.10 crore with his acquaintance and builder, Kamlesh Keshavbhai Gondaliya.
Between January and August 2025, Mistry transferred the entire payment from his HDFC Bank account to the accused's Bank of India account through cheques and RTGS transactions.
Kamlesh Gondaliya subsequently executed a registered sale deed for the shop on May 31, 2026.
Finance Company Seals Shop Over Unpaid Loan
The alleged fraud came to light on August 9, 2026, when Mistry visited the shop and found its shutter sealed by Aditya Birla Capital Finance.
He contacted Kamlesh's younger brother, Rajesh Gondaliya, who reportedly told him that the loan process was underway.
The buyer later received a no-objection certificate (NOC) from Kamlesh through WhatsApp. However, the document raised further questions because it carried the name of Mistry's father, Gitesh Jayantibhai Mistry, instead of the actual buyer's name.
The NOC also showed a zero balance against an amount of ₹2,02,64,000.
Builders Allegedly Concealed Project Loan
Further investigation revealed that the accused had allegedly taken a project loan from Aditya Birla Capital Finance by keeping the property as security but did not disclose the outstanding liability to the buyer before selling the shop.
Despite receiving the full ₹1.10 crore sale consideration, the brothers allegedly failed to repay the loan and used the money for personal purposes.
They also allegedly prepared a forged NOC in the name of the buyer's father instead of the buyer to mislead him about the property's loan status.
Maninagar Police Register Case Against Two Brothers
Following Mistry's complaint, the Maninagar police registered a case against Kamlesh Gondaliya and Rajesh Gondaliya for alleged cheating and criminal breach of trust.
Police have initiated an investigation into the property transaction, the outstanding loan and the allegedly forged NOC.
