A 67-year-old businessman who bought a house in Ahmedabad’s Nikol area for ₹21.25 lakh through an IndiaBulls Finance auction has alleged that the former owner forcibly took control of the property and refused to let him enter. The buyer, Sumitbhai, claims that even after the sale deed was registered and the former owner’s legal challenges were dismissed, he was unable to regain possession. Nikol Police have registered a case following directions from the District Collector.
House Purchased Through Finance Company Auction
According to the complaint, IndiaBulls Finance put a house belonging to Harkesh Bhadoriya in Rukshmani Tenament up for auction in 2011. Sumitbhai, a resident of Vejalpur, participated in the auction at the company’s Law Garden office and submitted the highest bid of ₹21.25 lakh.
He paid ₹1.96 lakh as a token amount and the remaining ₹19.29 lakh through a pay order. The finance company issued him a sale certificate on August 27, 2011, after which he registered the sale deed at the Nikol Sub-Registrar’s Office and took possession.
Sumitbhai said he carried out furniture work at the house and lived there with his family for around 20 months.
Former Owner Allegedly Took Over the Property
The complaint states that on the evening of June 11, 2013, Sumitbhai received a call from Madhubhai Ahir, who worked at the property, informing him that a group of people had arrived and forcibly evicted him.
When Sumitbhai reached the house with his son, Harsh, he allegedly found Bhadoriya and several associates there. Bhadoriya allegedly prevented him from entering the property.
Legal Challenges Dismissed
Bhadoriya later challenged the registered sale deed before the Gujarat High Court through a Special Civil Application. The complaint states that a division bench dismissed the application on October 11, 2012. His curative petition before the Supreme Court was also dismissed on December 10, 2025.
After the legal proceedings, Sumitbhai approached the District Collector with an application under the state’s land-grabbing provisions. Following a direction from the Collector to register an FIR, he lodged a complaint at Nikol Police Station.
Police have registered a case against Bhadoriya and begun further investigation.
